Preventing Elder Abuse

There are legal tools to help prevent situations in which others can abuse older adults.

One set of tools is for a mentally capable older adult to prepare legal documents in which they name one or more alternative decision-makers. If an older adult does not have legal documents in place and loses mental capacity, the court can make orders naming persons to make decisions for them. A decision-maker named in a legal document or court order has a legal duty to act in the adult’s best interests and faces consequences if they do not.

There are different legal tools for making financial decisions, personal decisions, and estate planning decisions.
